Mandatory steps before registering a trademark in Ukraine

For the successful functioning and development of a business in Ukraine and abroad, an important step is the registration of your own trademark (also referred to as a brand name, trade sign, or service mark).

The importance of trademark registration lies in the following:

  • Legal Protection: Obtaining protection against the use of the trademark by other persons without permission. Without protection, there is a risk that unscrupulous competitors might register the trademark first, subsequently banning you from using it and leveraging your recognition and reputation to sell their own goods.

  • Identification: Identifying your own product to increase recognition and trust among your customers.

An application for trademark registration in Ukraine is submitted to the Ukrainian National Office for Intellectual Property and Innovations (UkrNOIPI).

However, before preparing and submitting the application, it is mandatory to perform the following actions:

  1. Define the List of Goods and Services: Determine the list of goods and services for which the trademark will be used, both at the current stage of business activity and for planned activities in the future. Once registration is successful, it is impossible to add an additional list of goods and services to that specific trademark registration.

  2. Conduct a Preliminary Search: Perform a search for already registered trademarks in Ukraine to ensure your name is not already taken by competitors. However, publicly available databases typically only show trademarks that are already registered. Information regarding trademarks for which an application has been submitted (but the registration process is still ongoing) is generally not available in the public domain.

  3. Perform an Advanced Search: To conduct a comprehensive preliminary search regarding existing trademark registrations (both those already registered and those currently in the application process), it is necessary to contact qualified specialists who have access to specialized databases.

Thus, performing these mandatory preliminary steps before registering a trademark is not merely a formality, but a necessary prerequisite for effective legal protection of the brand and for avoiding risks that could jeopardize the business in the future.
